(Email & Text Message Marketing and Notifications)

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your participation in and use of the email and text message (SMS/MMS) communications provided by Enhance Your Chance Title 1 Community Development Center, Inc. (“Enhance Your Chance,” “we,” “us,” or “our”).

By providing your email address and/or mobile phone number, and by confirming your subscription (including through online forms, paper forms, event sign-ups, or text message opt-in), you:

  • Acknowledge that you have read and understand these Terms and our Privacy Policy;

  • Agree to be bound by these Terms and the Privacy Policy; and

  • Represent and warrant that you are authorized to enroll the phone number you provide.

If you do not agree to these Terms, please do not subscribe to our email or SMS services or promptly unsubscribe/opt out.

2. Description of Services

We offer email and SMS/MMS communications to provide information and support to families and community members, primarily in Hillsborough County, Florida and surrounding areas, including:

  1. Email Communications

    • Newsletters and program information

    • Educational resources and community opportunities

    • Event invitations and updates

    • Fundraising and donation opportunities, where appropriate

  2. SMS Communications: Purpose and Types (Required Disclosure)
    Our SMS/MMS text message program may include:

    • Program & Event Notifications: reminders about class sessions, workshops, meetings, and community events;

    • Community Alerts: time-sensitive notifications about schedule changes, closures, and other important announcements;

    • Promotions and Opportunities: information about new or existing programs, services, and fundraising efforts related to Enhance Your Chance’s nonprofit mission.

Many of our communications are informational and educational in nature, focused on community development, Title I educational support, and program-related updates. Some messages may include fundraising requests or program promotions supporting our nonprofit mission. We do not engage in traditional commercial telemarketing on behalf of third‑party businesses, and we do not sell your mobile number or other contact information to third parties for their own marketing use.

These communications may be sent using automated technologies as permitted by law, including autodialers or other automated systems, consistent with the Telephone Consumer Protection Act (TCPA) and applicable Florida laws such as the Florida Telephone Solicitation Act (FTSA).

3. Eligibility and Enrollment

To participate in our email or SMS programs, you must:

  • Be at least 18 years old or a legal guardian of a minor participant, or

  • Otherwise have the legal capacity to agree to these Terms; and

  • Provide a valid email address and/or mobile phone number that you own or control.

By enrolling, you represent that:

  • You are the account holder or the authorized user of the phone number provided; and

  • You authorize us and our service providers to send messages to that number under these Terms.

4. Consent to Receive Emails and Text Messages

By subscribing and confirming your enrollment, you:

  1. Email Consent (CAN‑SPAM)

    • Consent to receive emails from us, including informational and promotional messages, consistent with the CAN-SPAM Act of 2003, 15 U.S.C. § 7701 et seq.

  2. SMS Consent Under the TCPA and Florida FTSA

    • Consent to receive SMS/MMS text messages at the mobile number you provided, including messages that may be sent using an automatic telephone dialing system or other automated technology, where permitted by law.

    • For Florida residents, we also seek to comply with the Florida Telephone Solicitation Act (FTSA), Florida Statutes § 501.059, and related Florida laws and regulations. Where applicable, those laws may require:

      • Your prior express written consent before we send certain automated or prerecorded messages or use an automated system to dial or select your phone number for telemarketing or solicitation purposes; and

      • Clear disclosure that you are not required to agree to receive such messages as a condition of receiving services (unless text-based communication is itself a core feature of the service and this is clearly explained).

    • You understand that consent is not a condition of receiving services or participating in our programs, except where text messaging is an intrinsic component of a specific service and that is clearly disclosed at the point of enrollment.

By providing your consent, you acknowledge that you understand these disclosures and authorize Enhance Your Chance to send you the types of messages described in these Terms, in compliance with federal law (TCPA) and Florida law (FTSA and related statutes), as applicable.

5. Message Frequency (Required Disclosure)

  • Emails: The number of emails you receive will vary based on your subscriptions, but you can generally expect approximately  emails per month, with occasional increases during special events, campaigns, or urgent announcements.

  • SMS/MMS Messages: You may receive up to  messages per week, although frequency may vary based on your level of interaction with our programs, responses, and participation in special events or urgent alerts.

We reserve the right to adjust frequency as necessary but will aim to keep it within reasonable expectations for community and program-related communication.

6. Message and Data Rates May Apply (Required Disclosure)

Your mobile carrier’s message and data rates may apply to our SMS/MMS messages and to any data usage associated with browsing links in messages.

  • You are solely responsible for any fees or charges billed by your carrier, including message fees, data charges, roaming charges, and other costs.

  • If you have questions about your text or data plan, contact your mobile carrier.

7. Opt-Out and Unsubscribe Instructions (Required Disclosure)

You may withdraw your consent and stop receiving messages at any time:

  1. SMS/MMS Messages

    • Reply “STOP” to any text message you receive from us to unsubscribe from our SMS program.

    • After you send “STOP,” we will send one final message confirming your opt-out and then you will not receive further text messages, unless you re-enroll.

  2. Email Messages

    • Click the “unsubscribe” or “manage preferences” link at the bottom of any marketing or promotional email.

    • Follow the on-screen instructions to adjust your preferences or unsubscribe completely.

We will process your opt-out or unsubscribe request in a reasonable time frame as required by CAN-SPAM, TCPA, FTSA, and other applicable laws.

8. No Sale or Sharing of Mobile Numbers (Required Disclosure)

  • We will not sell, lease, exchange, rent, or otherwise transfer your mobile phone number to third parties for their independent telemarketing, solicitation, or commercial advertising purposes.

  • We may use your mobile number internally and share it only with service providers that assist in sending our messages, under strict confidentiality and data protection obligations.

For the avoidance of doubt, and consistent with Florida consumer protection and telephone solicitation laws (including FDUTPA and FTSA), we do not sell your mobile number or use it for third-party marketing.

9. Use of Services and User Responsibilities

You agree to:

  • Use our email and SMS services only for lawful purposes and in accordance with these Terms;

  • Not use our communications in a manner that violates any federal, state, or local law or regulation, including but not limited to:

    • The Telephone Consumer Protection Act (TCPA) and related FCC rules;

    • The CAN-SPAM Act;

    • The Florida Telephone Solicitation Act (FTSA), Florida Statutes § 501.059;

    • The Florida Telemarketing Act, Florida Statutes §§ 501.601–501.626, to the extent applicable; and

    • The Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Florida Statutes §§ 501.201–501.213.

You are responsible for:

  • Keeping your contact information accurate and up to date.

  • Maintaining security over your devices and accounts to prevent unauthorized use of our communications.

10. Service Modifications, Suspension, and Termination

We reserve the right, to the fullest extent permitted by law, to:

  • Modify, suspend, or discontinue the email or SMS services (in whole or in part) at any time, with or without notice;

  • Limit or terminate your enrollment if we believe you have violated these Terms, misused the services, or engaged in unlawful or harmful behavior;

  • Block any messages we reasonably suspect to be fraudulent, abusive, or violating applicable laws.

You may discontinue your participation at any time by using the opt-out procedures described in Section 7.

11. Intellectual Property

Content we send through email or SMS (including text, logos, graphics, and other materials) is owned or licensed by Enhance Your Chance and protected by applicable copyright and trademark laws.

  • You may use such content solely for your personal, non-commercial, and educational purposes in connection with our programs.

  • You may not reproduce, distribute, modify, or create derivative works from such content without our prior written permission, except as permitted by law (such as fair use).

12. Disclaimers

To the fullest extent permitted by law:

  1. “As Is” and “As Available”

    • Our email and SMS services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

  2. No Guarantee of Delivery or Timeliness

    • We do not guarantee that messages will be delivered in every case or without delay. Delivery and timeliness depend on various factors beyond our control, including network and carrier performance.

  3. No Professional Advice

    • Communications may contain educational or informational content, but they do not constitute legal, medical, or professional advice. For specific advice, please consult qualified professionals.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Enhance Your Chance, its officers, directors, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in, or inability to use, the email or SMS services.

  • Our total liability to you for any direct damages arising from or related to these services shall not exceed the greater of (a) fifty dollars ($50) or (b) the amount you have paid to us specifically for these communications services, if any (typically zero).

Some states do not allow limitations on implied warranties or the exclusion or limitation of certain damages, so parts of this section may not apply to you, and you may have additional rights.

14. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Enhance Your Chance and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your breach of these Terms;

  • Your misuse of the email or SMS services; or

  • Your violation of any applicable law or regulation, including federal laws (such as TCPA and CAN-SPAM) and Florida laws (such as FTSA, the Florida Telemarketing Act, and FDUTPA).

15. Governing Law and Dispute Resolution

These Terms and your use of our email and SMS services are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, and by applicable federal laws, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227;

  • The CAN-SPAM Act of 2003, 15 U.S.C. § 7701 et seq.;

  • Florida’s Telemarketing and Telephone Solicitation laws, including the Florida Telephone Solicitation Act (FTSA), Florida Statutes § 501.059, and the Florida Telemarketing Act, Florida Statutes §§ 501.601–501.626, to the extent applicable; and

  • Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA), Florida Statutes §§ 501.201–501.213.

Any disputes arising under or in connection with these Terms will be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts, unless a different forum is required by applicable law.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the “Last updated” date at the top of these Terms; and

  • Provide additional notice as required by law (for example, via email, text, or website posting).

Your continued participation in the email or SMS programs after such changes constitutes your acceptance of the revised Terms.
